Loss of Valuable (Household) Services
Loss of Household/ Valuable Services is a head of damage that looks at the contribution the injured person made to household tasks (interior and exterior) prior to the incident. When an injured person can no longer contribute to the household tasks, they have the right to seek compensation for the cost of hiring someone to perform these services for them.
Household tasks refer to the everyday tasks, chores, and responsibilities required in maintaining and managing a household’s upkeep, cleanliness, and functioning.
For example, if the injured person due to his/ her injury in a motor vehicle collision, is unable to do all the usual things he/ she did for the household, i.e. cooking, cleaning, grocery shopping, gardening, maintenance, laundry, driving to and from medical appointments, etc., he/ she has sustained a loss because they have to hire and pay someone to perform those tasks. Even if a spouse or family member provided those services without charge (i.e., gratuitously provided), those services still have a value. The value is determined by simply calculating how much the injured person would have to pay someone else to perform that service.
